Terms of Agreement:
The terms of this Agreement shall become effective upon signature and shall remain in effect for three years after the date of signature, unless restricted or terminated earlier. An Arizona Post Acute Care Capacity Tracker user
will be required to renew the Post Acute Care Capacity Tracker User Agreement on a three-year basis. ADHS may, in its sole discretion, terminate a user account at any time, including in response to any unauthorised or
inappropriate use.
Agreement Provisions
I, hereby attest in submitting this form that the facility identified will only use the data as follows *
ADHS has a duty pursuant to A.R.S. § 18-522 Anti-identification Procedures to develop and establish commercially reasonable procedures to ensure the security of entity identifying information. In
consideration of the Department's duty and my responsibilities as a PACCT user, and in recognition of the potential harm or discomfort that could be caused by the release of sensitive, provisional, and/or facility information
obtained while using PACCT, I agree to the following provisions:
Only the following authorized use will be allowed: Survey Users: Will only access and view the PACCT survey in order to input the required reporting information. Users have a
responsibility to ensure the accuracy of the information inputted into this application. Users may be given the capacity to download their own facility's data at a later date. Dashboard Users: Will only use the PACCT dashboard
information for patient placement from their own healthcare system or for public health surveillance. The dashboard information is to be viewed by authorized users only and shall not be made publically available.
Not to share my PACCT information (including user ID, password, or facility information) with anyone not authorized to enter this information or allow unauthorized users (anyone
outside my organization or unauthorized individuals within my organization) to view the PACCT Dashboard or any other PACCT data (including information inputted into a survey).
To require any and all facility employees or agents that receive or have been given proper access to the PACCT to agree to the same terms and conditions included in this Agreement.
To use all information viewed or accessed on the PACCT solely for the purposes of public health, patient placement or emergency preparedness and not for personal or commercial gain.
To not share or otherwise disclose any PACCT information without the explicit consent of ADHS.
To request consent, email pacct@azdhs.gov with what information you want to share, with whom you want to share it, and via what platform you want to send, share or distribute the
information. ADHS will evaluate your request and in no way is obligated to give consent.
Unauthorized release of PACCT information may result in immediate termination of access and notification will be sent to the user's facility administrator and/or supervisor.
To report any use or disclosure of PACCT information of which it becomes aware that is not permitted by this Agreement.
If it is discovered the use or disclosure of PACCT information is not reported, ADHS reserves the right to limit or revoke access for violation(s) of this provision.
To not override or circumvent the security procedures related to PACCT. This includes not introducing any harmful technology, or otherwise attempting to interfere with the proper
working of PACCT, or any portion thereof.
